INTRODUCTION OF CONSTRUCTION PRODUCTS TO THE EU MARKET

A general condition for labelling products with the CE marking is the existence of a harmonised standard or of ETA (European Technical Approval), the conformity with which the product is to be assessed. Despite the fact that CPD has already been in force for many years, not all construction products can be labelled with the CE marking because the harmonised standards and the ETA do not exist for them. Although each year a large number of harmonised standards are issued, there still remain a large number of products, the conformity of which must be assessed in accordance with national regulations.

The CPD therefore applies to all construction products, i.e. on the one hand to the products for which harmonised standards exist and that are labelled with the European mark of conformity, CE, and on the other hand the products for which their national regulations are still applicable.

The group of construction products which may be labelled with the CE marking shall be assessed in accordance with the Council Directive 89/106/EEC and with the harmonised standards; the result of the conformity assessment is an EC certificate of conformity or a production management system certificate and the subsequent labelling of the product with the CE marking.

The group of construction products which fall under national legislation is assessed in accordance with the national technical regulations (in the Czech Republic in accordance with the Government Order No. 163/2002 Coll. laying down technical requirements for specific construction products). Also because this area is not covered by the harmonised standards, the conformity assessment process uses the traditional specified standards and a system of construction technical certificates. The end-result is a product certificate or a production management system certificate.

Dividing of the construction products into these 2 groups is not explicitly defined in the CPD; only some of its articles refer to the products labelled CE; the others are of general application. The implementation of the CPD to the harmonised and national legislation will have another important effect: as of the date of the publication of the harmonised standard, a product may be assessed in either manner, but after the termination of the transition period activities may only be undertaken in accordance with harmonised standards.
